DMCA & Copyright Policy

iTribe Project respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement.

1. Filing a DMCA takedown notice

If you believe content on the Platform infringes your copyright, send a written notice to our Designated Copyright Agent at tech@itribe.us. Your notice must include ALL of the following:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
  3. Identification of the specific material you claim is infringing, including the exact URL(s) on the Platform.
  4. Your contact information: full legal name, mailing address, telephone number, and email.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be actioned. Knowingly false notices are subject to liability for damages under 17 U.S.C. § 512(f).

2. What happens after we receive a valid notice

We will promptly remove or disable access to the reported content and notify the user who posted it, providing a copy of your notice (we may redact your phone number before forwarding).

3. Counter-notifications

If your content was removed and you believe the takedown was incorrect (e.g., misidentification, fair use), you may submit a counter-notice to tech@itribe.us containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the US, any district in which iTribe may be found), and that you will accept service of process from the original complainant.

Upon receiving a valid counter-notice, we will forward it to the original complainant. Unless the complainant files a court action within 10-14 business days, we may restore the removed content.

4. Repeat infringers

We terminate the accounts of users who are found to be repeat infringers, consistent with 17 U.S.C. § 512(i).

5. Fair use

Before filing a notice, please consider whether the use is protected by fair use, fair dealing, or another exception. If you are unsure, consult an attorney.
